A46. FOR PUNJAB, SOME LEGAL CHANGES ARE NEEDED
The present government has excluded
disputes related to revenue and many other
departments from the point of view of looting,
outside the jurisdiction of the civil court.
That is why these departments are a source of
corruption. The main reason for land fraud is
the exclusion of revenue from the jurisdiction
of civil and judicial courts. No department
should be outside the jurisdiction of the Civil
and Judicial Court. Justice should not be a
victim of politics.
No landlord, no house, no corrupt robber could
seize one's family. To ensure this, the law of
the land should be brought back. Every owner of
property has the right to sell his property. But
he should first give notice of the price he gets
to his rights. Failure to do so will result in
the transfer of ownership to any right holder in
the event of a secret transfer of ownership. In
this way no capitalist will be able to buy the
property of a poor person for pennies.
If a corrupt robber fraudulently seizes the land
and property of an illiterate or poor man, under
the current law, when he goes to court to seek
justice, he has to pay a large sum of court fees
according to the total value of the land. ,
Which becomes millions of rupees even in
ordinary cases. That idea has already been
looted by the looters. Where will he pay
millions of rupees? Even after paying this
amount, he is not sure of justice. The court fee
does not have to be paid at the first stage, but
if he succeeds in getting his property back, the
court fee has to be paid.
Indian law in many cases gives
the complainant a double benefit. He can also
file a case in a civil court and lodge a
criminal case with the police. This is usually
done to crush political opponents. One court
finds the accused innocent but the other court
finds him guilty. In this way the litigation
becomes very long and goes to the Supreme Court.
The complainant has to choose only one option.
If found guilty, the criminal court may order
the return of the money or property.
It is the job of the judiciary to see the
seriousness of any crime. It is the court's job
to convict or acquit of any crime, whether moral
or political. No government has the right to
detain any opponent as it wishes, for a long
time, illegally. There have been serious
allegations against this tradition during the
Badal government. The government should prepare
a register every year without pardoning the
prisoner. Each prisoner should be informed of
the date of release one month before his
release. The prisoner should be released within
24 hours after completion of his sentence. In
case of negligence on the part of any officer
due to any particular reason, the concerned
officer should be responsible for giving
compensation as per the status of the prisoner.
To curb
corruption, it is imperative that no government
has the authority to change the fatwa issued by
the judiciary. Under the existing law, the Chief
Minister can release any detainee. This law may
have come into being with a good purpose. But
its use in Punjab has fueled corruption. It is
not used for ordinary people. On the contrary,
it was through this that the loved ones of the
Chief Minister were liberated, many of whom also
had large criminal backgrounds. On the contrary,
even after serving their sentences, men without
the patronage of the Chief Minister have been
lodged in jails for years. Who have no hope of
release for life. Because the government has
denied their existence. The government should
not give the Chief Minister the power to
overturn court decisions. But if they feel that
a person has been wrongly convicted for a
particular reason, the government can seek his
release by sending a detailed case to the High
Court for his pardon.
Property agents and property dealers must be
licensed to prevent fraudulent sale and purchase
of property. Property advisors should also be
considered property agents. Every contract and
registry deed must be signed by the property
agent. Every contract must have Patwari's
signature on the registry. The property agent
should prepare four layers of the contract. Out
of which one received the receipt by depositing
it with the seller, one with the buyer, one with
the agent, one with the tehsildar. At the time
of registration, they were attached to the
contract. It is the responsibility of the
property agent to check the land documents.
Agents could not charge more than one percent
commission from buyers and sellers. In the case
of non-submission of affidavit, the stamp took
five times. All costs should be borne by the
buyer.
A person who buys, develops or constructs a
property in his own name is considered a
property dealer. The dealer should give a copy
of his account to the registrar every year. The
basis on which property-gain taxes were
calculated. Property dealer licenses are
separate and individual from colonization
licenses. In this way the property dealer will
be relieved of the hassle of Colonization Act.
Property prices will rise.
Ex-servicemen have been struggling for a long
time to implement the principle of equal rank
equal pension. The majority of them are
Punjabis. The government passed a resolution in
the Punjab Vidhan Sabha to put pressure on the
central government. A resolution passed by a
state becomes a legal obligation for the Center.
If the Union Government still does not agree,
then the Punjab Government should provide
special facilities to the ex-servicemen.
Police morale has plummeted in Badal state.
Beating police by government-sponsored
celebrities has become a habit. In political
galleries, those who beat the police have been
treated with great respect. Every day, under
political patronage, there are reports of police
officers being beaten. No action can be taken
against them. In the end, it is the police
officer who is forced to step on the victim's
feet.
This is the state of the bureaucracy.
Corrupt politicians are not only targeting
honest, hardworking and capable bureaucrats but
also glorifying them. The junior employees have
a union, but they have no union, no voice. The
internal situation is very pitiable. Now the
question arises that if the morale of the police
or bureaucracy goes down like this then what
will happen to the society? Who will protect
life and property? Who will protect the dignity
of daughters and sisters? Action must be taken
against the politicians responsible for boosting
the morale of the police and bureaucrats. The
government ensured justice for all.
